Effective Date: February 26, 20261. IntroductionWhyHi, Inc. (“WhyHi,” “we,” “our,” or “us”) operates the WhyHi mobile application and related services (collectively, the “Services”). This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our Services. By using WhyHi, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Services.2. Information We Collect2.1 Information You ProvideWhen you create an account and use WhyHi, we collect information you provide directly, including: your phone number (used as your primary authentication credential and to enable the user directory); your display name (visible to other users in the directory and during calls); your email address (used for account recovery and service communications); your profile photo (optional, displayed to your connections); and any feedback or support inquiries you submit through in-app contact features.2.2 Information CollectedWhen you use the Services, we automatically collect certain technical and usage information, including: usage data such as call invitations sent and received, call durations, feature interactions, and connection request activity; device information such as device type, operating system version, app version, and unique device identifiers; and log data such as access times, error logs, and diagnostic information.2.3 Device Motion and Location DataWhyHi may access device motion and approximate location data to power availability features (such as detecting when you may be driving or unavailable). This data is processed on your device and is not transmitted to or stored on our servers.2.4 Information We Do Not CollectWe do not record the audio or video content of your calls. We do not record or store the content of your in-app messages. We do not use cookies, tracking pixels, or similar web tracking technologies. We do not sell, rent, or trade your personal data to third parties for advertising or marketing purposes.3. How We Use Your InformationWe use the information we collect for the following purposes: providing the Services, including account creation, authentication, call functionality, connection requests, and the user directory; sending service-related communications including SMS notifications related to calls and account verification; analytics and improvement to understand how users interact with the app; safety and security to detect, prevent, and respond to fraud, abuse, and security incidents; and legal compliance to fulfill legal obligations and respond to lawful requests.4. Third-Party Service ProvidersWe use trusted third-party service providers to operate and improve the Services. These providers process data on our behalf and are contractually obligated to protect your information. Our current service providers include: Google Firebase and Firestore for authentication, database, cloud functions, and push notifications; Agora for real-time voice and video call infrastructure; Twilio for SMS messaging for call notifications and service communications; Mixpanel for product analytics; DigitalOcean for cloud infrastructure and hosting; MailerLite and Mailgun for transactional and service email delivery; Google Workspace for internal business operations; and Anthropic and OpenAI for AI-powered in-app support features (no personal user data is sent to these services).We do not share your personal data with third parties for their own advertising or marketing purposes. Data shared with service providers is limited to what is necessary to perform their specific function.5. SMS Communications and ConsentWhyHi sends SMS messages to facilitate the core calling experience, including pre-call notifications letting a recipient know someone wants to call, and post-call follow-up messages. By creating an account and agreeing to our Terms of Service during onboarding, you consent to receive these service-related SMS messages from WhyHi.When a WhyHi user initiates a call to a phone number that is not associated with an active WhyHi account, WhyHi may send up to two SMS messages per call attempt to that number on behalf of the calling user: one pre-call notification and one post-call message. These peer-initiated notifications are sent as a service to the calling user. The post-call message will include opt-out instructions. Recipients who are not WhyHi users will not receive any further messages beyond those two per call attempt unless a new call attempt is made by the same or another WhyHi user.You may opt out of non-essential SMS communications at any time by replying STOP to any message. Essential service messages such as account verification may still be sent as required. For help, reply HELP to any message or contact us at [email protected]. Message and data rates may apply. Message frequency varies based on your use of the Services.6. Data RetentionWe retain your personal data only for as long as necessary to provide the Services and fulfill the purposes described in this Privacy Policy.Active accounts: Your data is retained for as long as your account remains active.Account deletion: When you delete your account through the app settings, we initiate a 30-day grace period during which your account is deactivated but your data is retained in case you change your mind. After 30 days, your personal data is permanently deleted from our active systems. Some data may persist in encrypted backup systems for up to 90 days before being fully purged.Aggregate data: Non-identifiable, aggregate analytics data may be retained indefinitely for internal analysis and product improvement.7. Data SecurityWe implement industry-standard technical and organizational safeguards to protect your information, including encryption in transit (TLS/SSL), secure authentication mechanisms, and access controls limiting data access to authorized personnel. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.8. Children’s PrivacyWhyHi is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal data from a child under 13, we will take steps to delete that information promptly. If you believe a child under 13 has provided us with personal information, please contact us at [email protected].WhyHi is a closed, trusted network. No user can contact another user without explicit, mutual connection consent. Users cannot receive calls, messages, or any form of communication from any other user unless the parties have accepted a connection request. There is no open directory browsing, no unsolicited messaging, and no way for any user to reach another without prior mutual agreement. This design provides an additional layer of protection for all users, including minors aged 13 and older who use the platform.9. Your Rights and Choices9.1 All UsersRegardless of your location, you may: access and update your personal information through the app settings; delete your account at any time through the app settings; opt out of non-essential communications; and remove connections or block other users at any time.9.2 California Residents (CCPA)If you are a California resident, you have the right to: know what personal information we collect and how it is used; request deletion of your personal information; opt out of the sale of personal information (we do not sell your data); and not be discriminated against for exercising your rights. To exercise these rights, contact us at [email protected].9.3 Canadian Residents (PIPEDA)If you are a Canadian resident, you have the right to access your personal information, request corrections, and withdraw consent to the collection and use of your information (subject to legal and contractual restrictions). If you access the Services from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries where our service providers operate. By using the Services, you consent to the transfer of your information to these jurisdictions, which may have different data protection laws than your home country.11. Changes to This Privacy PolicyWe may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. Material changes will be communicated through the app and via email. Your continued use of the Services after any changes take effect constitutes your acceptance of the revised Privacy Policy. The effective date at the top of this document will be updated with each revision.12.
